Bosch MeasureOn Terms and Conditions of use ("TERMS")

1. Overview.

General. Robert Bosch Tool Corporation and its subsidiaries and affiliates (collectively, “Bosch”) provide Bosch products, including laser distance measuring tools with digital connectivity capability purchased through an authorized Bosch dealer (“Dealer”) (such products referred to in the Terms collectively as “Bosch Products”) and the related services, software and systems, including without limitation the “MeasureOn Mobile App” software application (hereinafter the “Software”) that may be downloaded to your mobile device (e.g., smartphone or tablet). The Software may be used to collect, compile and analyze job site information, including without limitation, collecting measurements from laser distance measuring tools (including Bosch Products), arranging, compiling and exporting photos, notes, floor plans and measurements (such functionality, the “Measuring Services”), and may be used in conjunction with optional paid Bosch-provided cloud, data and/or web services to synchronize, backup and process such information (such optional services, the “Data Services”; the Measuring Services and any utilized Data Services are collectively referred to in these Terms as the “Services”), all for use in conjunction with Bosch Products. Certain portions of the Services require Paid Subscriptions, as further described below; for details, see Section 4, Paid Subscriptions. The Services can be used in ways that integrate with Bosch Products and products and services provided by third parties.

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING THE SOFTWARE OR THE SERVICES.

BY ACCESSING OR USING THE SOFTWARE OR THE SERVICES, YOU AND THE INDIVIDUAL OR THE ENTITY YOU REPRESENT ACCEPT AND ACKNOWLEDGE THAT THE TERMS FORM A LEGAL AGREEMENT BETWEEN YOU AND BOSCH WHICH GOVERNS YOUR USE OF THE SOFTWARE AND THE SERVICES. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE THE SOFTWARE OR THE SERVICES.

Intended Use of Services. The Services are intended to be accessed and used for (i) non-time-critical information; and (ii) collection, compilation and analysis of job site information, including without limitation the use of Bosch Products for taking measurements and arranging, compiling and exporting photos, notes, floor plans and measurements. The Services are not intended to be reliable or available 100% of the time. The Services are subject to sporadic interruptions and failures for a variety of reasons beyond Bosch’s control, such as service provider downtime, failure of mobile notifications and carriers, among others.

Complete Terms. By accessing or using the Software or the Services, you agree to these Terms, as well as the Privacy Statement which is located at the following websites: https://www.boschtools.com/us/en/more/apps/measureon/mobile/privacy-policy/ or https://www.boschtools.com/us/es/mas/apps/measureon/mobile/privacy-policy/ or https://www.boschtools.com/ca/fr/suite/apps/measureon/mobile/privacy-policy/ (“Privacy Statement”), each of which is incorporated herein by reference. These Terms also incorporate (a) the Apple, Inc. (“Apple”) Terms and Conditions (located at https://www.apple.com/legal/internet-services/itunes/us/terms.html) including, without limitation, the Licensed Application End User License Agreement (together, “Apple Terms”), and (b) the Google Inc. (“Google”) Google Play Terms of Service (located at https://play.google.com/about/play-terms.html) including, without limitation, the Google Play Business and Program Policies (located at https://policies.google.com/terms) (together, “Google Play Terms”). Except as expressly set forth in these Terms, to the extent there may be a conflict among these Terms, the Apple Terms, the Google Play Terms, these Terms control.

2. Eligibility, System Requirements, Updates.

Eligibility. The terms “you,” and “end user” as used in these Terms, means any (i) person 18 years of age or older, or (ii) entity, who accesses or uses the Software or the Services. Only persons aged 18 years or older may use the Software or the Services. By using the Software or the Services, you represent and warrant that you are at least 18 years old and otherwise have the capacity to contract.

Use in the United States and Canada. The Software and the Services are only intended for use by end users residing or using the Software or the Services in connection with facilities located in the United States, Canada and their respective territories and possessions (the “Territory”). If you use or attempt to use the Software or the Services from outside of the Territory, end users do so at their own risk and must comply with applicable laws (including data privacy regulations) in these other countries. Bosch makes no representations or warranties that the Software or the Services will operate or comply with applicable laws anywhere other than in the Territory.

System Requirements. The Services will not be accessible without mobile devices such as smartphone or tablet (“Devices”) and other system elements that may be specified by Bosch. Access to some the Data Services may require (i) an Account (as such term is defined below), (ii) working access to data or cellular connectivity that can communicate reliably with the applicable Device(s), and/or (iii) a web browser . It is your responsibility to ensure that: (1) you have all required system elements, and (2) they are compatible and properly configured. You acknowledge that the Services may not work as described when the requirements and compatibility have not been met. Additional carrier or data fees may apply; see your internet or mobile data carrier for details.

Software Updates. From time to time, Bosch or third parties providing the Software and/or Services may develop upgrades, updates, patches, bug fixes and other modifications to improve the performance or compatibility of the Software and/or the Services (“Updates”). You acknowledge and agree that Updates will either be manually installed with notification or automatically installed on your Devices or other hardware without providing any additional notice to you or receiving any additional consent from you. You acknowledge that you may be required to install Updates to use the Software and/or Services with the Bosch Product and you agree to promptly install any Updates if so required. You acknowledge that you shall be liable for any damages that occur as a result of your failure to install Updates as recommended by Bosch. These Terms shall apply to any Updates that are made available to you by Bosch at any time, unless such Updates are governed by a separate license agreement.

3. Accounts

You are not required to register for an account to use Bosch Products with the Software. However, in order to access the Data Services, including the synchronization, backup and data processing features, with your Bosch Product, you must register for an account with the SingleKey ID authentication service (an “Account”). Your use of the SingleKey ID service is subject to the SingleKey ID service’s terms and conditions (the current version is available at https://singlekey-id.com/en-us/terms-of-use/), which you must agree to when you create your Account. The data protection notice for the SingleKey ID Service is available at https://singlekey-id.com/en-us/data-protection-notice/. Bosch.IO GmbH, Ullsteinstrasse 128, 12109 Berlin, Germany is responsible for the provision of the SingleKey ID single sign-on service.

If your information changes at any time, please update your Account to reflect those changes. You agree to promptly notify us of any unauthorized use of your username, password or other Account information, or of any other breach of security that you become aware of involving your Account or the Services.

4. Access to Software and Services; Subscriptions; Certain Limitations and Restrictions; Termination

Access and Use. Subject to these Terms, Bosch grants you a limited, revocable, non-transferable, non-sublicensable, non-exclusive, right to access and utilize the Software and Services to collect, compile and analyze job site information, including without limitation, using Bosch Products for taking measurements, collecting measurements, arranging, compiling and exporting photos, notes, floor plans and measurements, and accessing optional paid Bosch-provided cloud, data, and/or web services to synchronize, backup and process such information (the “Permitted Purpose”). You are permitted to store and print the documentation provided by Bosch, provided you (i) do not modify or delete any existing copyright notices, (ii) use such documentation and copies thereof only for the Permitted Purpose, and (iii) reproduce only such numbers of copies which are necessary for such Permitted Purpose. You may not permit any third parties to access the Services, and are responsible and liable for any such access. Certain portions of the Services require Paid Subscriptions, as further described below; for details, see Section 4, Paid Subscriptions. Subject to these Terms, Bosch grants you a limited, revocable, non-transferable, non-sublicensable, non-exclusive, right to install the Software only for use on your Device or the Device(s) of the entity you represent (e.g., iPhone, iPad, or Android smartphone) for the Permitted Purpose.

Bosch reserves the right to modify any Services provided free of charge, to make new Services available either free of charge and/or on a fee basis, and to discontinue the provision of free Services at any time in its sole discretion.

Paid Subscriptions and Free Trials. Certain features and/or parts of the Services are only available on a paid subscription basis (“Paid Services”, and such subscriptions, “Paid Subscriptions”). With any Paid Subscriptions, you will be billed in advance on a recurring and periodic basis (“Billing Period”). Billing Periods are set on a monthly or yearly basis. The time period, scope of Paid Services, and other additional terms applicable to Paid Subscriptions will be described at the time you select the tier of Paid Subscription you wish to purchase (unless you are accessing a Free Trial (as defined below) – see below for details on how Free Trials work). These additional terms and conditions are incorporated into this Agreement by reference and you acknowledge and agree that such terms are legally binding to your use of the Services.

Paid Subscriptions are purchased from and billed by the Apple App Store or Google Play Store (each, an “App Store”), as the case may be, and are subject to the terms and conditions of the applicable App Store (for the Apple App Store, see https://www.apple.com/legal/internet-services/itunes/; for the Google Play Store, see https://play.google.com/about/play-terms/index.html). All billing and refund inquiries must be directed to the applicable App Store. Bosch does not have access to App Store accounts or transactions. If you wish to confirm the type of Paid Subscription that has been purchased from an App Store, please consult your App Store account or receipt as each Paid Subscription will have a unique billing name.

Your Paid Subscription will be charged to your account with the applicable App Store at confirmation of purchase. Your Paid Subscription will automatically renew at the price listed in your App Store account (subject to any applicable taxes) at the end of your current Billing Period unless you cancel it at least 24 hours prior to the end of the current Billing Period.

You can manage your Paid Subscription or turn off auto-renewal at any time from your App Store account settings. Cancellation of the active Paid Subscription for the current Billing Period is not allowed. When your Paid Subscription to the Paid Services ends, you will continue to have access to data on your Device but lose access to any functionality of the Paid Services that requires Paid Subscription.

Bosch may change, modify, or eliminate features of the Paid Subscription at any time, with or without notice.

You may be able to access and evaluate the Paid Services for limited time before being billed for your Paid Subscription with a free trial (a “Free Trial”). The time period, scope of Paid Services, and other additional terms applicable to the Free Trial will be described at the time you select the tier of Paid Subscription you wish to evaluate. These additional terms and conditions are incorporated into this Agreement by reference and you acknowledge and agree that such terms are legally binding to your use of the Services. You will be billed for your Paid Subscription upon the expiration of your Free Trial unless you cancel your Paid Subscription before the Free Trial expires. You acknowledge and agree your access to any data or customization you apply or enter into the Paid Services during your Free Trial will not be accessible via the Paid Services upon the end of the Free Trial unless you subscribe to the Paid Subscription; consequently, any such data or customizations not synchronized to certain of your Devices will not be available on such Devices.

All purchases are final. Bosch cannot and does not issue refunds for purchases charged to your App Store account. If you have a billing dispute, you must contact the App Store to seek a remedy. As it relates to Paid Subscriptions and Free Trials, to the extent of a conflict between these Terms and the above referenced terms and conditions of the applicable App Store, the terms and conditions of the applicable App Store shall control.

Subscription Fee Changes. Bosch, in its sole discretion and at any time, may modify the fees for the Paid Subscriptions. Any Paid Subscriptions fee change will not go into effect automatically; you must opt into the fee change to continue using the Paid Subscription after the end of the then-current Billing Period. If you do not opt in to the fee change, your Paid Subscription will be automatically terminated at the end of the then-current Billing Period. See Termination, Suspension and Termination of Services below for more information.

Restricted Activities. The rights granted to you in these Terms are subject to the following restrictions: You may not (i) rent, lease, sublicense, sell, transfer, assign, redistribute, host, or otherwise commercially exploit the Software, Services or any accompanying documentation; (ii) modify, make derivative works of, disassemble, reverse compile, attempt to find the source code of, or reverse engineer any part of, the Software, Services or any accompanying documentation; (iii) access the Software or the Services in order to build a similar or competitive service; (iv) except as expressly stated herein, copy, reproduce, distribute republish, download, post, display or transmit any part of the Software or the Services in any form or by any means; (v) upload, transmit, or distribute any computer viruses, worms, Trojan horses, malware, spyware, adware or any software intended to delay, disrupt, damage, alter or interfere with a computer or communication network, computer, handheld mobile device, data, the Services, the Bosch Products, or any other system, device or property; (vi) interfere with, disrupt, or attempt to gain or facilitate unauthorized access to, the servers or networks connected to the Services or violate the regulations, policies, or procedures of such networks; (vii) access (or attempt to access) any of the Services by means other than through the interface(s) provided by Bosch; (viii) access or use the Services in a way intended to avoid incurring fees; (ix) remove, obscure or alter any proprietary rights notices (including copyrights and trademark notices) which may be contained in or displayed in connection with the Software or the Services (x) make the Services and/or your Account available to third parties or allow third parties to use the Services and/or your Account; (xi); test, scan or investigate the Software or the Services for vulnerability, and/or breach, compromise or circumvent the Software or the Services’ security or authentication measures; (xii) use devices, software or routines intentionally which have a disruptive effect on the Services’ functions or usability or destroy other data, systems or communications deliberately, generate excessive load, interfere maliciously or intercept or take over fraudulently any Software of Services (or part thereof); (xiii ) use the Services as your own permanent storage; (xiv) have the right in a data center environment; (xv) gain access to nonpublic areas of the Services or their underlying technical systems; or (xvi) use robots, spiders, scrapers or other comparable tools for data collection or extraction, programs, algorithms or methods for searching, accessing, acquiring, copying or controlling the Data Services beyond any documented API endpoints. Any future release, update, or other addition to functionality of the Software or the Services shall be subject to these Terms.

IF YOU ARE A CONSUMER SUBJECT TO THE QUEBEC CONSUMER PROTECTION ACT, THE IMMEDIATELY FOLLOWING TERMINATION PROVISION DOES NOT APPLY TO YOU.

Termination, Suspension. These Terms will remain in full force and effect so long as you continue to access or use the Software or the Services, or until terminated in accordance with the provisions of these Terms. Bosch reserves the right, at any time, to modify, suspend, or discontinue the Software or the Services or any part thereof with or without notice. You agree that Bosch will not be liable to you or to any third party for any modification, suspension, or discontinuance of the Software or the Services or any part thereof. Without limiting the above, the Data Services may be suspended temporarily without notice for security reasons, system failure, maintenance and repair, or other circumstances. Bosch does not offer any specific uptime guarantee for the Services.

Termination of Services. Upon termination of your Account, your right to use the Data Services will automatically terminate. For information on what happens with Customer Data upon termination of an Account, see Customer Data section below.

Location-based Services. Location-based services may require information from your Device to provide functions. When you turn on or use these features, details will be provided regarding what information is sent to Bosch and how the information may be used. You can learn more by reading our Privacy Statement available at https://www.boschtools.com/us/en/more/apps/measureon/mobile/privacy-policy/ or https://www.boschtools.com/us/es/mas/apps/measureon/mobile/privacy-policy/ or https://www.boschtools.com/ca/fr/suite/apps/measureon/mobile/privacy-policy/. When you use any location-based features within the Services, certain location-related and usage information will be sent to Bosch in an anonymized form, in order to process your request and help improve Bosch Products and Services. Such location and usage data is transmitted to Bosch in a form that does not personally identify you. By using the location services and use features on Bosch Products, you agree and consent to Bosch’s and its agents’ transmission, collection, maintenance, processing, and use of this information, to provide and improve Bosch Products’ features and service, other Bosch products and services, and Bosch marketing initiatives. However, you may opt-out of Bosch using such information for marketing purposes and to improve Bosch products and services, at any time, by contacting Bosch as set out at section 6 below, “Customer Data; Processing of Data; Personal information”. Non -personalized location data (i.e., IP address and region) is shared with and or accessible to Bosch’s enterprise tag management and marketing service provider. Bosch may also provide such information, in either an aggregated or non-personally identifiable form, to its partners and licensees to help improve their location-based products and services. You may disable the location-based functionality of Bosch Products by unplugging your Bosch Product and activating flight mode. Certain location-based features will however be unavailable if you disable the location services setting, such as tool tracking and use. Neither Bosch nor any of its content providers guarantees the availability, accuracy, completeness, reliability, or timeliness of stock information, location data or any other data displayed by any Services.

5. Third-Party Products and Services.

General. Certain aspects of the Services rely on or interoperate with third party products and services (“Third Party Technology”). The Third Party Technology may include data storage, processing , synchronization, and communication through Microsoft Azure or other alternative providers. You acknowledge that the availability of the Services is dependent upon (i) the proper installation, treatment and upkeep of your Bosch Products, (ii) your Device(s), computer, internet connectivity wiring, wireless connection, and other related associated equipment (“Associated Equipment”), (iii) your Internet service provider (“ISP”), (iv) your Device(s)’ carrier(s) (“Carrier”), (v) the App Stores from which you download the Software, and (vi) any third party web browser software you used to access the Services (e.g., Chrome, Firefox, Edge, Safari, etc.). You acknowledge that you are responsible for all fees charged by your ISP and Carrier in connection with your use of the Services. You also acknowledge that you are responsible for compliance with all applicable agreements, terms of use/service, and other policies of your ISP and Carrier. These third party products and services are beyond Bosch’s control, but their operation may impact the use and reliability of the Services. YOU AGREE NOT TO RELY ON THE SERVICES FOR ANY PERSONAL SAFETY OR TIME-CRITICAL PURPOSES.

Release Regarding Third Parties. Bosch is not responsible for third parties or their products and services, including Third Party Technology, Associated Equipment, ISPs, Carriers and App Stores (collectively, “Third Party Products and Services”). Bosch hereby disclaims and you hereby discharge, waive and release Bosch and its licensors and suppliers from any past, present, and future claims, liabilities, and damages, known or unknown, arising out of or relating to your interactions with such third parties and Third Party Products and Services. YOU HEREBY WAIVE CALIFORNIA CIVIL CODE SECTION 1542 IN CONNECTION WITH THE FOREGOING, WHICH STATES: “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.” YOU HEREBY WAIVE ANY SIMILAR PROVISION IN ANY OTHER JURISDICTION.

Disclaimer. YOU ACKNOWLEDGE AND AGREE THAT: (I) THE USE AND AVAILABILITY OF THE DATA SERVICES IS DEPENDENT ON THIRD PARTY PRODUCTS AND SERVICES; (II) THE THIRD PARTY PRODUCTS AND SERVICES MAY NOT OPERATE IN A RELIABLE MANNER AND THEY MAY IMPACT THE WAY THAT THE DATA SERVICES OPERATE; (III) BOSCH MAKES NO REPRESENTATION OR WARRANTY ABOUT THE OPERATION, USE, SAFETY OR RELIABILITY OF ANY THIRD PARTY PRODUCTS AND SERVICES; (IV) BOSCH IS NOT RESPONSIBLE FOR ANY THIRD PARTY’S COLLECTION, USE, PROTECTION, DISCLOSURE OR OTHER PROCESSING OF PERSONAL INFORMATION; AND (V) BOSCH IS NOT RESPONSIBLE FOR DAMAGES AND LOSSES DUE TO THE OPERATION OF THE THIRD PARTY PRODUCTS AND SERVICES OR THE DATA SERVICES, INCLUDING ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE (INCLUDING TO YOUR HOME OR FACILITY), INTERRUPTION OF SERVICE, DOWNTIME, PRIVACY BREACH, DATA LOSS, OR ANY OTHER HARM OR LOSSES ARISING FROM OR RELATING TO YOUR USE OF ANY OF THE DATA SERVICES OR THIRD PARTY PRODUCTS AND SERVICES.

6. Customer Data; Processing of Data; Personal Information.

Customer Data. You warrant that: (a) you and/or your licensors hold all rights to all data, information (including, but not limited to, personal information), content or material provided by you or on behalf of you in connection with your access to the Software or the Services (the “Customer Data”), including as required for the use rights to the Software or the Services granted under these Terms and to grant the rights to the Customer Data as set forth in below; and (b) the Customer Data does not violate these Terms or any applicable laws and does not infringe the intellectual property or privacy rights of a third party.

You hereby grant to Bosch the right to use the Customer Data, for the purpose of providing the Services, in particular the right to reproduce such Customer Data for this purpose (e.g., for data back-up), to modify it and to provide such Customer Data to Bosch affiliates and third party service providers for the purpose of storing and accessing such Customer Data and providing support to Customer .

You understand and agree that the Customer Data will be kept by Bosch at a data center in one or more of Germany, Netherlands and/or Ireland, and will be accessible to service operations team members who have a need to access such information for the purposes of providing and supporting the Services. You shall regularly back up the Customer Data (whether by data export or platform-provided backup procedure). Bosch is not responsible for data loss associated with failure to back up or otherwise export Customer Data.

Bosch is entitled to immediately suspend your use of and access to the optional paid Bosch-provided cloud, data and/or web services to synchronize, backup and process data related to the Services if there is reasonable belief that the applicable Customer Data is unlawful and/or infringes third party rights. For example, Bosch has the right to suspend your use of and access to the Data Services if a court, other authorities and/or any third party notifies Bosch of your unlawful or potential unlawful use of the Services, or of an infringement of third party rights. Provider shall notify you of the suspension, stating the reason for such suspension. The suspension shall be removed as soon as practicable after the reasons for the suspension are no longer present.

Customer Data which has been downloaded to a Device from the Data Services will remain accessible on such Device(s) in the event your Account is terminated. Once your Account has been terminated, you will no longer have access to the Data Services.

Processing of Data. Your submission of information through the Services is governed by our “Privacy Statement,” which is located at the following websites: https://www.boschtools.com/us/en/more/apps/measureon/mobile/privacy-policy/ or https://www.boschtools.com/us/es/mas/apps/measureon/mobile/privacy-policy/ or https://www.boschtools.com/ca/fr/suite/apps/measureon/mobile/privacy-policy/. You agree that all information you provide to us is true, accurate, and complete, and you will maintain and update such information regularly. The main function of the Services is to allow you to collect, compile and analyze job site information, including without limitation, using Bosch Products for taking measurements, collecting measurements, arranging, compiling and exporting photos, notes, floor plans and measurements, and optionally accessing paid Bosch-provided cloud, data and/or web services to synchronize, backup and process such information (i.e., the Data Services); some of the foregoing Services are Paid Services requiring a Paid Subscription – see Section 4, Paid Subscriptions above for details.

The Services will access certain data to enable for setup and access of the collection and analysis features of these Bosch Products. Without limiting the above, you acknowledge that the Customer Data may include the following personal information: (1) information submitted or created when registering your account, and/ or applying for a centralized SingleKey ID, including SingleKey ID, passcodes, surname, first name, date of birth, company name, email address, telephone numbers, mail address; (2) geolocation information when you use location services, as further described in section 4 “Access to Software and Services; Subscriptions; Certain Limitations and Restrictions; Termination”; and (3) any personal information submitted in the course of using the Services, including photographs containing images of you or your property; (4) personal information regarding your customers, which you store in connection with the Services, including such customers’ names, company names, addresses, email addresses and phone numbers; and (5) information collected automatically in connection with your use of the Services, including IP address, device data, details of files uploaded (such as file name, file path, file size, timestamp), information regarding the Service features that you use, and information regarding your online activities. Such personal information will be processed in accordance with our Privacy Statement, and is only used for the purposes of providing our Services, improving Bosch products and services and other internal business purposes, and Bosch marketing initiatives (including online behavioural advertising), and other purposes required or permitted by applicable law. However, you may opt-out of Bosch using such information for marketing purposes and other non-essential purposes by contacting Bosch as described below.

You understand and agree that Bosch may share personal information that we collect in connection with the Services with Bosch affiliates and third party service providers in order to provide you the Services and provide access to the central SingleKey ID service. Bosch affiliates may also use the information to administer, maintain, personalize and improve their own websites, products and services, unless you inform us that you do not want your information used for such purposes. You further understand and agree that Bosch may transfer, store or otherwise process Customer Data outside the country where you are located, and accordingly, any personal information contained therein may be accessible to foreign courts, law enforcement and national authorities.

You confirm that, by providing personal information to Bosch, you are aware that the transmission of information via the internet is not completely secure. Although Bosch will endeavor to protect your personal information, we cannot guarantee the security of your personal information transmitted via the Services. Any transmission is at your own risk. Once we have received your personal information, we will use industry standard procedures and security features to secure your personal information from unauthorized access.

You represent and warrant that (a) all personal information you provide to, or that is provided on behalf of you, to Bosch hereunder is owned by you or you have the right to provide such information to Bosch for use by Bosch in connection with the Services; and (b) Bosch’s authorized processing of such information does not and will not violate or infringe any applicable privacy, security or data protection laws or regulations. Without limiting the generality of the foregoing, to the extent that the Customer Data contains any personal information regarding any individual other than yourself (including, without limitation, any information regarding your customers as well as photographs of any individual or his/her property), you understand and agree that you are solely responsible for providing any notice(s) and obtaining any consent(s) required pursuant to applicable law, in order to allow Bosch to collect, use and disclose such personal information for the purposes of providing its Services. You agree that you shall keep appropriate records of such notice(s) and consents, and shall promptly produce evidence of such notice(s) and consent(s) upon Bosch’s request.

7. Ownership and Intellectual Property

Bosch Property. You acknowledge that all right, title and interest in, to and associated with intellectual property rights, including without limitation registered and unregistered copyrights, patents, trademarks, and trade secrets, in the Software and Services, including any Content (as defined below) forming any part of the Services or the Software, are owned by Bosch or its affiliates or licensors. End users’ possession, access, and use of the Software and Services does not transfer to end users or any third party any rights, title, or interest in, to or associated with such intellectual property rights. Bosch and its affiliates, licensors and suppliers reserve all rights not granted in these Terms. The Software and Services are licensed to end users, not sold, under these Terms. End users may not use the Content of the Software or Services in any other public or commercial way, nor may end users copy or incorporate any of the Content of the Software or Services into any other work.

For the purposes of this Section 7, the term “Content” means all materials and content including designs, editorials, text, graphics, audiovisual materials, multimedia elements, photographs, videos, music, sound recordings, reports, documents, software, information, formulae, patterns, data and any other work, as well as source code, processes, designs, technologies, URLs, domain names, trademarks and logos forming any part of the Software.

The Software may link to or otherwise make available Content from third parties (collectively, “Third Party Content”). That Third Party Content is theirs and not yours, and may be governed by terms and conditions applicable to Third Party Content. Nothing in these Terms grants you any right, title or interest in, or ownership of Third Party Content.

Feedback. End users may choose to, or Bosch may invite end users to submit comments, suggestions, or ideas about the Software or Services, including how to make improvements (“Ideas”). By submitting any Ideas, end users agree that their submissions are voluntary, gratuitous, unsolicited, and without restriction and will not place Bosch under any fiduciary or other obligation. Bosch may use, copy, modify, publish, or redistribute the submission and its contents for any purpose and in any way without any compensation or attribution to end users. End users also agree that Bosch does not waive any rights to use similar or related ideas previously known to Bosch, developed by its employees, or obtained from other sources.

Copyright Notice. The Software, Services, and all Content therein is owned by Bosch and its licensors, and is licensed to you in accordance with these Terms only. All rights are reserved.

Trademark Notice. The trademarks, logos, and service marks displayed on or through the Software and/or Services are the property (whether registered or unregistered) of Bosch, and its licensors. You are not permitted to use Bosch trademarks, logos and service marks for any purpose without Bosch’s prior, written consent.

No Use Of Trademarks Implies Any Endorsement, Sponsorship or Affiliation. Except as expressly indicated in the Services, no endorsement, sponsorship, affiliation or other authorization is implied by any use of third party trademarks.

Third Party Trademarks. You acknowledge and agree that it is your responsibility to obtain permission to access or use intellectual property, including trademarks, logos and service marks, owned by third parties. In some cases you may not be able to obtain such permission. Where such permission cannot be obtained, you shall not use the third party intellectual property and you acknowledge and agree that you will be liable for any unauthorized use.

8. Open Source Software.

The Software and/or Services may include open source software and third party software under royalty free licenses (“FOSS”).

The FOSS in the Software and/or Services is subject to FOSS license agreements (“FOSS-Licenses”). The FOSS-Licenses for all FOSS contained in the Software and/or Services will be available at [include link] and in the Software itself. Pursuant to these FOSS-Licenses, Bosch has to pass on to you their terms and conditions and you have to comply with these terms and conditions and fulfill respective obligations when using the FOSS in another way than merely installing and running it internally on your machines, e.g. through further disposal of the product, as by distribution, selling, or otherwise passing it on to a third party. The rights under the FOSS-Licenses are being granted to you, and in the event of you passing on a copy of the product to another party, the terms and conditions of the respective FOSS-Licenses apply to the distribution of any included FOSS (in some cases, the FOSS-License provides a direct license from the author/licensor of the FOSS to the third party). For many FOSS-Licenses, BOSCH itself can neither grant nor obtain these rights for you. The applicable FOSS-Licenses are available on the internet address of the provider of the FOSS or will be made available by BOSCH upon your request.

The FOSS itself does not contribute to the sales price of the Services and thus is provided without royalty or monetary compensation.

You have to, either expressly, or implied by amendment or adaptation of the FOSS, accept and take responsibility for Your compliance with the applicable FOSS-Licenses. Further, you have to agree that updates or new versions of the Services may contain different or additional FOSS or changes in the FOSS-Licenses.

If any terms or restriction of this Agreement conflict with the license conditions of FOSS included in this product, the terms and conditions of these FOSS-Licenses shall prevail.

9. Indemnification.

You agree to defend, indemnify and hold Bosch and its licensors and suppliers harmless from any damages, liabilities, claims or demands (including costs and attorneys’ fees) made by any third party due to or arising out of (i) your use of the Software, (ii) your use of Services, (iii) your violation of these Terms, (iv) any Ideas you provide; or (v) your violation of any law or the rights of any third party. Bosch reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Bosch and you agree to cooperate with our defense of such claims. You agree not to settle any such claim without Bosch’s prior written consent. Bosch will use reasonable efforts to notify you of any such claim, action or proceeding upon becoming aware of it.

10. Warranty Disclaimers.

(a) Disclaimers of Warranties.

IF YOU ARE A CONSUMER SUBJECT TO THE QUEBEC CONSUMER PROTECTION ACT, THE WARRANTY DISCLAIMERS CONTAINED IN THIS SECTION 10 DO NOT LIMIT YOUR RIGHTS AND REMEDIES UNDER SUCH ACT, INCLUDING THE RIGHT TO MAKE A CLAIM UNDER ANY OF THE STATUTORY WARRANTIES PROVIDED UNDER SECTIONS 34 TO 54 OF SUCH ACT.

(i) EXCEPT AS SPECIFICALLY PROVIDED IN THESE TERMS, THE SOFTWARE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” AND BOSCH MAKES NO WARRANTIES, EXPRESS, IMPLIED, ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, OR STATUTORY, AS TO THE SOFTWARE OR SERVICES, OR ANY MATTER WHATSOEVER. BOSCH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, TITLE AND NON-INFRINGEMENT.

(ii) TO THE EXTENT APPLICABLE, FREE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND AND BOSCH MAKES NO WARRANTIES, EXPRESS, IMPLIED, ARISING FROM COURSE OF DEALING OR USAGE OF TRADE, OR STATUTORY, AS TO THE FREE SERVICES. BOSCH DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, TITLE AND NON-INFRINGEMENT. ADDITIONALLY, BOSCH DOES NOT WARRANT THAT THE FREE SERVICES WILL MEET ANY CUSTOMER REQUIREMENTS OR THAT THE FREE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED. BOSCH DOES NOT WARRANT THAT THE USE OF FREE SERVICES WILL NOT BE IMPAIRED BY DOWNTIME, MAINTENANCE ACTIVITIES, FURTHER DEVELOPMENTS, UPDATES AND UPGRADES OR MALFUNCTIONS.

(b) Limitations on Liability.

IF YOU ARE A CONSUMER SUBJECT TO THE QUEBEC CONSUMER PROTECTION ACT, THE LIMITATIONS OF LIABILITY CONTAINED IN THIS SECTION DO NOT RELEASE BOSCH FROM THE CONSEQUENCES OF ITS OWN ACTIONS OR THE ACTIONS OF ITS REPRESENTATIVES.

(i) BOSCH SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, WHETHER BASED ON CONTRACT, TORT OR ANY OTHER LEGAL THEORY (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA OR ANY OTHER CONTENT, LOST PROFITS, BUSINESS INTERRUPTION, OR ANY OTHER LOSSES), ARISING OUT OF ANY USE OF THE SOFTWARE OR THE SERVICES OR ANY PERFORMANCE OF THESE TERMS (INCLUDING, WITHOUT LIMITATION, USE, INABILITY TO USE, OR THE RESULTS OF USE OF THE SERVICE(S), OR SECURITY BREACHES RELATED TO THE SERVICE(S)).

(ii) BOSCH’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE AMOUNT PAID BY CUSTOMER FOR ANY PAID SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING A CLAIM. THE ABOVE LIMITATIONS WILL APPLY WHETHER AN ACTION IS IN CONTRACT OR TORT AND REGARDLESS OF THE THEORY OF LIABILITY.

(c) The limitations of this Section 10 shall apply regardless of whether any remedy set forth herein fails in its essential purpose or otherwise.

11. Apple iOS Special Terms and Conditions.

If you use an iOS product, such as an iPhone or iPad (an “iOS Device”) with the Software, you agree to the following terms and conditions (“Apple Special Terms”) to the extent they apply to your use of the iOS Device. Nothing in the Apple Terms or these Apple Special Terms will be deemed to change or limit our agreement with you.

Acknowledgement. You and Bosch acknowledge that these Terms are concluded between you and Bosch only, and not with Apple, and that as between Bosch and Apple, Bosch is solely responsible for the Services and the content thereof.

Additional License Terms. Your right to use the Services is limited to use on an iOS Device owned or controlled by you as permitted by the Usage Rules contained in the Apple Terms and in accordance with these Terms.

Additional Usage Rules. In addition to the usage rules set forth in these Terms, you shall comply with the Usage Rules contained in the Apple Terms.

Maintenance and Support. You and Bosch acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Software.

Warranty. As between Apple and Bosch, Bosch is solely responsible for any warranties related to the Software or Services, to the extent not disclaimed or limited above. In the event of any failure of the Software or Services to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the Services to you; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation to you whatsoever with respect to the Services, and, subject to the above disclaimers and limitations of liability, as between Apple and Bosch, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure of us to conform to any warranty will be Bosch’s sole responsibility.

Product Claims. You and Bosch acknowledge that as between Apple and Bosch, Bosch is responsible for addressing any claims of you or any third party relating to the Services or your possession and/or use of the Services, including, but not limited to: (i) product liability claims; (ii) any claim that the Services fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

Intellectual Property Rights. You and Bosch acknowledge that, in the event of any third-party claim that the Services or your possession and/or use of the Services infringe that third party’s intellectual property rights, as between Apple and Bosch, we will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

Third Party Beneficiary. Apple and Apple’s subsidiaries are third party beneficiaries of the Terms, and all agreements incorporated into the Terms by reference. Upon your acceptance of the Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce the Terms against you as a third party beneficiary thereof.

12. Google Play Special Terms and Conditions.

If you use an Android device (“Android Device”) and download the Services through Google Play, you agree to the following terms and conditions (“Google Play Special Terms”) to the extent they apply to your use of the Android Device. Nothing in the Google Play Terms or these Google Play Special Terms will be deemed to change or limit our agreement with you.

Acknowledgement. You and Bosch acknowledge that these Terms are concluded between you and Bosch only, and not with Google, and that as between Bosch and Google, Bosch is solely responsible for the Services and the content thereof.

Technical Support. You may only contact Bosch concerning any defects or performance issues in the Services downloaded and installed from Google Play. Bosch is solely responsible for, and Google will have no responsibility to undertake or handle support and maintenance of the Services. Bosch will respond to customer support inquiries within three (3) business days or less.

Intellectual Property Rights. You and Bosch acknowledge that, in the event of any third-party claim that the Services or your possession and/or use of the Services infringe that third party’s intellectual property rights, as between Google and Bosch, we will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

13. Governing Law; Venue.

If you are a resident of the United States, (i) these Terms and Conditions will be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflicts of laws provisions; and (ii) you consent to exclusive jurisdiction in the state courts of Michigan with venue in the County of Oakland.

IF YOU ARE A CONSUMER SUBJECT TO THE QUEBEC CONSUMER PROTECTION ACT, THE IMMEDIATELY FOLLOWING JURISDICTION PROVISION DOES NOT APPLY.

If you are a resident of Canada, (i) these Terms will be governed by and construed in accordance with the laws of the Province of Ontario, without regard to its conflicts of laws provisions; and (ii) you consent to exclusive jurisdiction in the courts of the Province of Ontario.

14. No Assignment.

These Terms, and all rights and licenses granted hereunder, may not be transferred or assigned by you without our prior written consent, but may be assigned by Bosch without restriction. Any attempted assignment by you will be null and void.

15. Export Control

Access to the Software and the Services is subject to local and international export and re-export control laws and sanctions regulations. You agree to comply with all applicable export and re-export control laws and sanctions regulations, of the Federal Republic of Germany, the European Union, the United States of America, Canada and the United Nations or any other applicable jurisdiction.

You acknowledge that subject to Section 2, Use in the US and Canada, some aspects of the Software or the Services may be accessed from any geographic location. You shall not - directly or indirectly – provide access to the Software or the Services to any destination, entity, or person prohibited or sanctioned by the laws and regulations of the Federal Republic of Germany, the European Union, the United States of America, Canada, the United Nations or any other applicable jurisdiction.

You shall not use the Software or the Services, or data resulting from the Software or the Services, directly or indirectly, for nuclear, chemical or biological weapons proliferation, development of missile technology or any other military purpose.

You shall indemnify, to the fullest extent permitted by law, Bosch, its affiliates, and their respective officers, directors, employees and agents from and against any and all fines, penalties or other cost arising from or in connection with your violation of any applicable export and re-export control law, sanction or regulation.

This Export Control section shall survive termination or cancellation of the contractual relationship between you and Bosch.

16. Force Majeure.

Any delay in the availability of the Services or non-performance of the Services shall not be deemed a breach of these Terms if such delay or non-performance is caused by a fire, earthquake, flood, war, terrorist act, government act, failure of common carriers (including Internet service providers), labor strike or walk-out, act of God, or any other event beyond the reasonable control of Bosch or its service providers.

17. Notices.

You agree that we may provide notices to you of changes to these Terms and/or our Privacy Statement, in one or more of the following ways: (a) a pop-up notice, web banner, push notification or other notification on or through Services; or (b) an email or regular mail sent to an address you provided.

18. Customer Support.

Specific questions about the Services should be referred to Bosch at measuring.appsupport@us.bosch.com.

19. Changes to these Terms.

Bosch may change these Terms in its sole discretion at any time. Bosch shall notify you of any such change the next time you open the Software on each Device (or if you are accessing some aspect of the Services via the web, the next time you access the Services via the web) by presenting the updated terms for your review and acceptance. In the event of an objection to the updated terms by you, such objection shall immediately terminate your use of the Software and Services in accordance with Section 4 of these Terms. All billing and refund inquiries must be directed to the applicable App Store.

This information may include, without limitation, your Name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, account name, email address, telephone number, company name, and any other information you choose to provide us.
  2. Indirectly from You. For example, from observing your use of the MeasureOn Application and/or the Services, or services related thereto. The following data may be collected automatically, pages viewed, duration of visit, browser used, IP address, and network information and operating system and version. If the visit is a result of online advertising such as banners, video ads, search engine advertising, etc., Bosch or its agents, representatives, may record which banner, adware, etc. motivated or assisted with the visit to MeasureOn Application.

Bosch will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated or incompatible purposes without providing you notice or obtaining your consent, where required by applicable laws in the relevant jurisdiction.

V. Disclosure, Sale and Sharing of Personal Information – Past 12 Months

Bosch may use, store, compile, manipulate, and disclose your personal information with third parties for the purposes stated above. Your personal information is disclosed with the following:

  • Bosch affiliated entities, including Bosch’s parent company in Germany, Robert Bosch GmbH, to leverage shared services and improve our Services;
  • Bosch service providers, marketing partners and other partners and entities performing work on Bosch’s behalf, such as hosting vendors, advertising service providers, data analytics companies, marketing service companies, list managers and delivery companies.   • Bosch.IO GmbH processes your data for the purposes of "registration and login with SingleKey ID", as well as "overview and maintenance of master data and apps with SingleKey ID" under joint responsibility with us. After one-time registration you can use SingleKey ID to log in. For this purpose you will be redirected to a login mask of Bosch.IO GmbH. After successful authentication, Bosch.IO GmbH will provide us with the required personal data (e.g. e-mail address, telephone number, first name, last name, language, country). Your password will not be transmitted to us.

You can terminate your SingleKey ID user contract at any time on the SingleKey ID website by deleting your SingleKey ID: https://singlekey-id.com/myprofile/. In addition, iCPM offers the possibility to log in to Bosch applications via different login options.

Login with SingleKey ID, Joint Controllership

You can log in to our website with SingleKey ID.

SingleKey ID was developed by Bosch.IO GmbH for the Bosch Group to provide users with an overarching login option on Bosch websites, stores, apps and services. Bosch.IO GmbH, Ullsteinstrasse 128, 12109 Berlin, Germany, is responsible for providing SingleKey ID.

By accessing and/or using the MeasureOn Application or the Services, you consent to the above uses and disclosure of your personal information in accordance with this notice.

Sale or Sharing of Personal Information . In the preceding twelve (12) months, Bosch has not shared or sold personal information for a business or commercial purpose. We do not share or sell your personal information for the business and commercial purposes listed in Section III, , therefore there is no opt-out for the selling or sharing of personal information.

VI. Use of Third-Party Web Analytics Tools

This MeasureOn Application uses web analytics tools, such as the Google Analytics web analytics tool, to provide us with an analysis of your use of the MeasureOn Application, overall use of and traffic on the MeasureOn Application and other related services. Google Analytics uses cookies that enable an analysis of your use of the MeasureOn Application. The information generated by the cookie about your use of the MeasureOn Application (such as when you visited the MeasureOn Application, pages viewed. Duration of your visit, browser used, IP address, details on the configuration of your operating system, your browser and your access provider) are generally transmitted to, and stored on, a server of Google located in the U.S. You are able to opt out of Google Analytics by downloading and utilizing the Google Analytics Opt-out Browser Add-on, which you can obtain at https://tools.google.com/dlpage/gaoptout?hl=en. Bosch has enacted Google’s Restricted Data Processing as to not constitute a sale or sharing of data with Google.

This MeasureOn Application uses functional, analytic, tracking cookies and similar techniques, also from third parties such as the Google Analytics, Tealium, Adjust, to analyze and improve Bosch and third parties’ services. The information generated about your use of the website (such as when you visited the website, details on the configuration of your operating system, your browser and your access provider) are transmitted to and stored on the respective third parties’ server.

The option provided by Bosch to configure settings for cookies has no effect on third party cookies, pixels, and active components (e.g., YouTube, Facebook, Google, Twitter). Refer to the respective providers’ websites for information about how they handle your data.

Bosch uses any information gathered by such analytics tools to analyze your use of the MeasureOn Application, to generate reports on website activities and to perform other MeasureOn Application related services to you. Only authorized persons have access to this anonymized data.

VII. Use of Social Plugins as Part of Social Media.

Bosch’s MeasureOn Application uses social media plugins (“Plugins”) from social networks like Google Play and Apple App Store. The Plugins are identified by the respective social media logo or the respective suffix (the “Button”).

If you visit a page on the MeasureOn Application that contains Plugins, your browser will establish a direct connection to the Social Network server and load the Button from there, At the same time the Social Network will know that the respective page on the MeasureOn Application has been visited. If you click on a Button, you establish a direct connection to the respective Social Network. By clicking the applicable Button, you accept and consent to the transmission of your data to the Social Network. If you are logged into the Social Network, it can also associate your visit to the MeasureOn Application to your Social Network account.

If you do not wish your data to be transmitted to the applicable Social Network via the MeasureOn Application, ensure that you are not logged into the Social Network before visiting the MeasureOn Application, and do not click on any Plugins while on the MeasureOn Application.

Our MeasureOn Application uses the YouTube video platform that enables playback of audio and video files. By visiting such websites, YouTube receives information that you have accessed the corresponding page on the MeasureOn Application. Such data is transmitted to YouTube whether you are logged into a YouTube user account or not.

For information about the scope and purpose of data collection by these social media companies, and your rights and the settings you can configure to protect your privacy, refer to their privacy policies.

VIII. International Data Transfer

Bosch may transfer your personal information to Bosch’s parent company in Germany, Robert Bosch GmbH, and/or to any other Bosch affiliates throughout the world, including, without limitation, Robert Bosch Tool Corporation, when processing, storing, analyzing, and otherwise using data. Bosch may also transfer your data to a service, provider, contractor, or third party outside the country of origin. Accordingly, your personal information may be accessible to courts, law enforcement and national authorities in countries other than the country in which you reside. IX. Children’s Privacy

Bosch does not knowingly collector use any personal information from online visitors under the age of 16. Bosch does not knowingly allow visitors under the age of 16 to participate in any promotions or contests made available on MeasureOn Applications from time to time.

X. California “Shine the Light” Privacy Rights

California’s “Shine The Light” law permits those Bosch customers who are residents of California to annually request a list of their personal information (if any) that Bosch disclosed to third parties for direct marketing purposes in the preceding calendar year, and the names and addresses of those third parties. At this time, Bosch currently does not share any personal information with third parties for direct marketing purposes.

XI. Use of Links to Affiliated Sites

The MeasureOn Application may contain links to other Bosch sites. The MeasureOn Application provides these links only as a convenience. Your use of these Affiliated Sites and any related services are outside the scope of this Privacy Notice and is governed by the Privacy Notice and any other terms referred to or located on such Affiliated Sites.

XII. Use of External Links

The MeasureOn Application may contain links to third-party websites or services operated by providers that are not associated with Bosch. After you click the link, Bosch no longer has any influence over the collection, storage, use or processing of any personal information transmitted by clicking the link (such as the IP address or URL of the page that contains the link), as the behavior of third parties is, by nature, beyond Bosch control. Therefore, Bosch is not responsible for the collection, storage, use, disclosure or other processing of personal information by such third parties. For further clarity, this Privacy Notice does not apply to any such third-party websites or services; refer to the privacy statements or policies for such third-party websites or services for information about how they collect, use, disclose and protect personal information.

XIII. Security

Bosch takes commercially reasonable efforts to ensure that your data collected by Bosch through this MeasureOn Application is protected against tampering, loss, destruction, access by unauthorized persons or unauthorized disclosure. Bosch security measures are being continuously improved in accordance with the state of technological developments, however, absolute protection is not possible.

When you register with Bosch, you are required to create a username and password. You must not share this access information with anyone else as you are personally responsible for any information transmitted while logged in with your username and password. We disclaim any and all liability for any information transmitted due to an unauthorized log in.

XIV. Use of Cookies

1. Bosch Cookies.

Bosch uses cookies and active components (e.g., JavaScript) to track visitors’ preferences and customize the design of the MeasureOn Application.

Cookies are small text files stored on your computer or device when you visit a MeasureOn Application. If you wish, you can delete the cookies at any time from your web browser. However, this can result in some functions no longer being available. For information on deleting the cookies, consult your browser‘s help function.

Bosch makes it possible to control the use of cookies. To do so, click the “Privacy settings” link in the footer. This link gives you additional information about the cookies used. In addition, you can configure which cookies you want to use there.

2. Third-Party Cookies.

Bosch’s MeasureOn Applications may incorporate content and services from other providers (e.g., YouTube, Facebook, Google, Twitter) who, in turn, may use cookies and active components. Bosch has no influence on the processing of personal information by these providers. The option provided by Bosch to configure settings for cookies used has no effect on cookies and active components from other providers (e.g. Google, Tealium, Adjust). Refer to the respective provider’s websites for information about how your data is handled.

3. Cookies, Tracking Mechanisms, and Cookie Retargeting

Cookies, Tracking Mechanisms, and Cookie Retargeting create user profiles by means of advertising cookies or third-party advertising cookies so called "web beacons" (invisible graphics that are also called pixels or tracking pixels), or by means of comparable technologies. These are used for interest-based advertising and to control the frequency with which the user looks at certain advertisements. The relevant provider of these tools is the controller responsible for the processing of data in connection with the tool. The providers of the tools might disclose information also to third parties for the purposes mentioned above. The data protection notices of the relevant provider in this context. The following may be incorporated into this website at various times for various marketing campaigns:

Function: We use Adjust in our mobile app. Adjust processes mobile identifiers such as IDFA or Google Play Services ID, among others, as well as the pseudonymized IP and, if applicable, MAC address of users, as well as certain information on in-app behavior, such as time and installation and first opening of the app on the device, user interactions within the app, as well as information about which ads users have seen or clicked on. The collected data is not assigned to any specific natural person without separate consent. Adjust uses this data on our behalf, for the creation of analyses and evaluations about the use of our app and the success of our campaigns. We use the information obtained through this to better understand the application, function and use of the app, for example, to determine through which marketing measure users became aware of our app, i.e. specifically, which link or banner on social networks (e.g. Facebook) users clicked on before downloading our app.

Processing of the advertising identifier / advertising ID

With your consent, we use the so-called ”advertising identifier” (IDFA) for devices with the iOS operating system and the so-called advertising ID for those with Android for advertising purposes. These are non-permanent identification numbers for a specific device which are provided by iOS or Android. The data collected through this is not linked with other device-specific information. We use the identification numbers in order to provide you with personalised advertising and to be able to analyse your usage. If you activate the ”No ad tracking” option in the iOS settings under ”Privacy” – ”Apple Advertising” or the ”Deactivate interest-based advertising” option on Android under ”Google Settings” – ”Advertising”, then we are only able to take the following measures: Measurement of your interaction with banners by counting the number of times a banner is shown without being clicked on (”frequency capping”), click rate, determination of unique usage (”unique user”) and security measures, fraud prevention and troubleshooting. You can delete the IDFA or the advertising ID at any time in the device settings (”Reset Ad ID”); a new identification number will then be generated which is not merged with the previously collected data. We would like to note that you may not be able to use all of the functions of our app if you restrict the use of the respective identification number.

This is a U.S. website and service targeted to users in the U.S. and Canada, and the MeasureOn Application and Bosch Services are subject to U.S. and Canadian laws, as applicable, including, without limitation, those governing the privacy and security of your information. If you use Bosch Services, you are transferring your information to Bosch in the United States. By using the Bosch Services or providing your information to Bosch through the Services you consent to the transfer of your personal information to the United States, and Bosch handling of your information in accordance with applicable U.S. requirements and this Privacy Notice. XIX. Response Timing and Format

We endeavor to respond to a verifiable consumer request or access request, as applicable, within forty-five (45) days of its receipt, or sooner where required by applicable law (including Canadian Privacy Laws). If we require more time (up 90 days in total), where permitted by applicable law, we will inform you of the reason and extension period in writing. Opt-out request will be honored as soon as feasibly possible, but no later than 15 days from the date we receive the request.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide in response to a verifiable consumer request will only cover the 12-month period preceding the verifiable consumer request's receipt, unless otherwise required by applicable law . The response we provide will also explain the reasons we cannot comply with a request, if applicable.

For data portability requests, where applicable, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request or access request, as applicable, unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

XX. Personal Information Sales: Opt-Out and Opt-In Rights

Bosch does not sell or share personal information for a business or commercial purpose, therefore there is no opt-out for the selling or sharing of personal information.

Based on your state of residence and if you are 16 years of age or older, you may have the right to direct us to not sell your personal information at any time (the "right to opt-out"). Furthermore, where required by applicable law in the relevant jurisdiction, we will obtain your consent prior to selling your personal information. XXI. Authorized Agent

I. California

As a California resident you may also exercise your request to know or request to delete through an authorized agent. When you submit your request through an authorized agent, we require that you:

  1. Provide us a copy of your written permission for the authorized agent to submit the applicable request; and
  2. Verify your own identity directly with us.

The foregoing does not apply when you have provided your authorized agent with a power of attorney pursuant to California Probate Code sections 4000 to 4465; provided, that we may require a copy of such power of attorney before fulfilling any request.

II. Colorado

As a Colorado resident you may also exercise your request to opt-out through an authorized agent. When you submit your request through an authorized agent, we require that you:

  1. Provide us a copy of your written permission for the authorized agent to submit the applicable request; and
  2. Verify your own identity directly with us.

XXII. Non-Discrimination; Financial Incentives

We will not discriminate against you for exercising any of your rights. However, we may offer you certain financial incentives permitted by applicable law that can result in different prices, rates, or quality levels. XXIII. Filing a Complaint

Regulatory authorities that oversee the privacy laws and regulations, including the Office of the Privacy Commissioner of Canada, advise individuals to file an objection or challenge with the relevant company before lodging a formal complaint with a regulatory authority.
